Terms of Service
Please read these Terms carefully — they govern your use of the ComicBrain mobile app.
1. Acceptance of terms
These Terms of Service ("Terms") form a binding agreement between you and Apparent Group Limited ("we", "us") governing your use of the ComicBrain mobile app and any related services (together, the "Service"). By creating an account or otherwise using ComicBrain, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent where you live, whichever is higher) to use ComicBrain. By using it you confirm you meet that requirement and have the authority to enter into these Terms.
3. Account registration
Some features require an account. You agree to give accurate registration information, to keep your password confidential, and to be responsible for what happens under your account. Tell us promptly at hello@apparentgroup.co if you suspect unauthorised use.
4. Licence to use the app
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use ComicBrain on devices you own or control, for your own non-commercial use. You may not copy, modify, reverse-engineer, resell or sublicence the Service except where applicable law says you may.
5. Your content
You keep ownership of the photos and notes you submit to ComicBrain ("Your Content"). You grant us a limited licence to host, process and display Your Content solely to operate the Service for you — for example running comic identification on a cover you photograph and storing the result in your collection. We do not use Your Content for advertising or model training.
6. Identification, grades and values are estimates
ComicBrain produces comic identifications, condition estimates and market values for informational and hobbyist use only. Identification and condition estimates are produced by automated systems and can be wrong, particularly on variant covers and reprints. Market figures shown in the app are ESTIMATES DERIVED FROM CATALOGUE DATA — they are not a live feed from any price guide, auction house or grading company, and the app labels them as such on screen. A condition estimate is not an official CGC, CBCS or PGX grade. Nothing in ComicBrain is a professional appraisal, authentication, grading opinion or financial advice, and any decision to buy, sell, insure or submit a book for grading is made entirely at your own risk.
7. Third-party names and marks
Character names, title names, cover artwork, publisher marks and grading-company names belong to their respective owners. ComicBrain is an independent tool and is not affiliated with, endorsed or sponsored by any comic publisher or grading company. Those names appear only to identify the books you scan.
8. Subscriptions, billing and cancellation
ComicBrain offers a paid subscription that unlocks the app. Subscriptions are sold and billed through the store you installed from (Apple App Store or Google Play). The price, any introductory offer and the renewal terms are shown on the purchase screen before you buy. Subscriptions renew automatically until you cancel through the store's subscription settings, and cancelling takes effect at the end of the current period. Refunds, where available, are handled by the store under its own policy.
9. Prohibited activities
You agree not to: (a) use ComicBrain to infringe anyone's intellectual property, privacy or other rights; (b) upload unlawful, harmful, harassing or sexually explicit content; (c) attempt to gain unauthorised access to other accounts or to our systems; (d) interfere with the operation of the Service; (e) use the Service to build or train a competing product; or (f) use automated systems to scrape or extract data from the Service.
10. Intellectual property
The ComicBrain app, brand, logo, design and underlying software are owned by Apparent Group Limited and protected by intellectual-property laws. Except for the limited licence above, no rights are granted to you by implication or otherwise.
11. Third-party services
ComicBrain depends on third-party services to function, including Google Firebase, Adapty, the Apple and Google billing systems, and the AI providers behind identification and Ask ComicBrain. Your use of those services may also be governed by their own terms, which we do not control.
12. Termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or end your access if you breach these Terms, if the law requires it, or if we discontinue the Service. On termination your rights under these Terms end immediately; the sections that by their nature should survive — including the estimate disclaimer, the warranty disclaimer and the limitation of liability — continue to apply.
13. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of identification, grading or valuation. We do not warrant that the Service will be uninterrupted or error-free, or that any defect will be corrected.
14. Limitation of liability
To the maximum extent permitted by law, Apparent Group Limited and its officers, employees and partners will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose, or USD 50 if you paid nothing.
15. Governing law and disputes
These Terms are governed by the laws of Hong Kong, without regard to its conflict-of-laws rules. The courts of Hong Kong have exclusive jurisdiction over disputes arising out of or relating to these Terms, except where the mandatory consumer-protection laws of your country of residence say otherwise.
16. Apple and Google store terms
If you download ComicBrain from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple, and that Apple has no obligation to provide support or maintenance. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Equivalent rights apply to Google for downloads from Google Play.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be flagged in the app and the effective date above will be bumped. If you keep using ComicBrain after a change takes effect, you accept the updated Terms. If you do not accept them, please stop using the Service.
